Rovin Net Referral Program Membership Agreement 

This document outlines the rights and responsibilities of Rovin' Net Internet Service and any of its customers involved in Rovin' Net promotional referral program.


AGE RESTRICTIONS:

United States: If you are under 16 years old and live in the United States, you need to obtain your parent(s) consent before applying for Rovin' Net Referral Program membership. 

PLEASE READ THE ENTIRE AGREEMENT SET OUT IN THE PAGES BELOW BEFORE PROCEEDING. 
OUR GOAL: We are working to provide our customers a fun and interesting way to earn recurring monthly cash payments in exchange for promoting Rovin' Net to their friends and family members. 

This Agreement lays out the terms for your general membership in the Rovin' Net promotional referral program. Please read it carefully before you agree to begin actively promoting Rovin' Net. Please note that becoming a Rovin' Net Internet Access customer means that you automatically meet the criteria for joining the Rovin' Net promotional referral program. Before you begin active promotion for pay, you will need to review and agree to the terms of Rovin' Nets referral program agreement. 

IF YOU DO NOT AGREE TO ALL THE TERMS OF THIS MEMBERSHIP AGREEMENT INCLUDING OUR PRIVACY POLICY, ROVIN' NET IS UNWILLING TO LET YOU BECOME A MEMBER OF THE ROVIN' NET REFERRAL PROGRAM. 

This General Agreement between you and Rovin' Net, a Louisiana corporation, sets out the terms of your responsibilities in the Rovin' Net promotional referral program. 

Our Privacy Policy. 

The purpose of Rovin' Net is to provide top-quality, reliable, and fast Internet Access to enable businesses and individuals to interact with the Internet community -- without forfeiting the privacy of our customers. As such, privacy is at the core of Rovin' Net. This statement outlines our privacy program and its terms are incorporated into this Agreement. We welcome your input about our policy. Give us your feedback at support@rovin.net. 

All information collected as a result of your membership in Rovin' Net will be controlled by Rovin' Net, a Louisiana company. Rovin' Net may transfer or share your information within the Rovin' Net group as part of maintaining your account details and tracking credits on referral earnings. It will only do this to improve the administration of the services. At all times Rovin' Net will follow this privacy policy. 

Disclosures of Your Information. We do not give, sell, rent, share, or trade any identifiable personal information regarding our members to any third party, with the exception of third-party contractors and service providers who work with Rovin' Net to provide tracking and accounting services. All such contractors are strictly prohibited from later use of the information that they may have access to. Rovin' Net may share non-personal aggregate, or summary, information regarding its members with partners or other third parties. We can - and you authorize us to - disclose personal information to local, state, or federal law enforcement officials when required to do so by public authorities or when we believe in good faith that the law requires it. 

Information We Collect as Part of General Membership. 

Online Registration Form. In our online registration form, we require you to provide us with your full name, full street address, email address and a password. In addition, we may require your city of birth, birth date, and a password question with its corresponding answer, so that we may identify you if you ever lose your password. We will process this information to administer your membership, to provide extended services, and to provide you with the full benefits of referral program membership as detailed below. 

Information We Collect and Manage as Part of the Referral Program. 

Information Gathered by Rovin' Net: To completely cancel your subscription and referral program membership in Rovin' Net and to have your personal data deleted from our systems, just notify us at support@rovin.net. You will then no longer be able to dial into our service or earn money as described in the general membership agreement.) 

Information required for Tax Purposes Related to the Referral Program. If You join the Rovin Net Referral Program and accrue more than $300 in your account we may contact you to request additional information including, for example, the Social Security number individual members or Federal Tax ID for business members. We will only use this additional information for legitimate purposes related to complying with applicable tax laws. If you are contacted and fail to provide us with the information we legitimately require, we may refuse to pay you until we receive that information. 

The Rovin' Net Referral Program uses cookies to prevent cheating and to confirm valid signups in order to update interdependent software databases. These cookies are non-persistent "session cookies," meaning that they are automatically deleted at the end of a session. 

We use an outside company to rotate and display ads on the Rovin Net Website and member portal. These ads may place cookies on your computer. While we use cookies in other parts of our Web site, cookies received with banner ads are monitored by our ad-serving company, and we do not have access to this information. However, we have contractual arrangements that restrict our partners, including the ad-serving company, from using these cookies for anything other than fulfilling their service to Rovin' Net.

Our Use of Your Information. In addition to uses of your information described above, Rovin' Net may use Your information in the following ways: 
Registration Information. We use your email address to verify your identity and protect against fraud and to contact you when you are due for a payment. In addition, we use it to send you updates about your account, new products and services, and company updates. If you participate in the referral program, we will use the address information to mail your check to you and to verify your location for tax purposes. We use URL information we collect to track referral links to help credit referrals to the proper customer. We use your IP address to help diagnose problems with our server and to administer our Web site. Your IP address is also used to gather broad demographic information. 

Transfer of this Agreement. Rovin' Net may transfer or share your information within the Rovin' Net Group as part of a transfer of your membership agreement. It will, for example, do this in order to improve the administration of the Rovin' Net services. At all times the Rovin' Net Group will follow this privacy policy and ensure the security and confidentiality of personal data. 

External Links. The Rovin' Net Website contains links to other Websites. Rovin' Net is not responsible for the privacy practices or the content of such Websites. 

Security. This site has security measures in place to protect the loss, misuse, and alteration of the information under our control. We use industry standard procedures and processes to safeguard the confidentiality of your identifiable personal information, such as firewalls, encryption, token authentication, application proxies, monitoring technology, and adaptive analysis of network traffic to track abuse of our network and its data. Unfortunately, when you submit information about yourself to Rovin' Net over the Internet the information may travel over many systems that are not under the control of Rovin' Net. The Internet is not 100% secure and others may intercept the information that you are sending. One easy and important way to protect your personal information is to guard your account password and close your browser when you step away from your computer. 

Consent to Process Personal Data/Choice/Opt-In/Opt-Out. Rovin' Net members constantly have the option to enter and exit the Rovin' Net referral program at any time and for any length of time. While active in the referral program, members consent to our Website recording data which will be used by Rovin' Net in accordance with this policy. Members who participate in the referral program have the opportunity to opt-out of informational emails at any time. Members are always free to close their account by sending an email to support@rovin.net. In such a case, your personal data will be destroyed.

A Special Note About Children. Rovin' Net wants to help parents protect the privacy of children and has taken steps to obtain legal age acknowledgment as part of the account setup process. Rovin' Net does not consider most areas our Website to be directed at children but some children may attempt to join Rovin' Net and by extension, the referral program. To remove your child from Rovin' Net or the referral program, please contact us at support@rovin.net. 

Contacting the Web Site. If you have any questions about this privacy policy, the practices of this site, or your dealings with this Web site, you can contact support@rovin.net. 

Updates to This Agreement. Rovin' Net may revise these terms from time to time. We will bring to your attention your right to object to the revision. We will notify you of each revision and you may object against to the updated version within a two week period. If you do object, we are entitled to cancel your membership upon two weeks notice. If you do not object, this will be considered as consent. Your continued use of the benefits of referral program membership after you receive our notification will signify your acceptance of the modified terms. 

Provide Accurate Information. You must provide Rovin' Net with valid contact and residence information and may not impersonate or misrepresent your identity. Rovin' Net reserves its rights under the laws to terminate your account, and associated membership, containing untruthful information for which you are responsible; 

Accounts are Not Transferable. Your password and account are personal to you and are not transferable; You may not allow anyone else to use Your password or account; You may not use anyone else's access password or dialup account or act to accrue referral program earnings for anyone else's account; You are responsible for keeping your password secret; Rovin' Net is not liable for any loss or damage caused by any disclosure of your password or account; You may only create an account for yourself and may not establish accounts on behalf of anyone else; 

Comply with Laws. You agree to comply with all of your local, state, province, country or regional legal restrictions that may be applicable to your membership in Rovin' Net; 

Cancel at Any Time. You may cancel Your Membership at anytime by notifying Rovin' Net at support@rovin.net or by using the Cancel Service form located on the Rovin' Net website. If you decide to cancel your membership and later wish to re-enroll, you will be assigned a new referral code number, you surrender all future referral earnings from your past account, and you will not receive further credit for referrals made during your previous participation in the referral program. Notwithstanding our right to terminate this Agreement without any notice for good cause, we may at any time terminate your membership by written six weeks prior notice; 

Lapsing of Account. If you cancel your Rovin' Net account or do not refer anyone to the service within any 1-year period, your referral program membership will automatically lapse without notice and any accrued credits in your account below the equivalent of U.S. $10 will be deemed "unearned" and will be forfeited. 

Your Relationship to Rovin' Net. Your relationship to Rovin' Net is one of an independent contractor and/or customer. No employee-employer relationship is created by your participation in the referral program. You do not have any obligation to refer new members to the Rovin' Net referral program.. Rovin' Net HAS NO OBLIGATION TO OFFER THE REFERRAL PROGRAM TO YOU. 

The Referral Program. As a Member of Rovin' Net, You may refer other people to the Rovin' Net membership program. You and your referrals are eligible to become participants in the referral program (subject to the discretion of Rovin' Net and subject to the terms and conditions of this agreement), you will be able to receive credits for the activity of referring members to Rovin' Net. Rovin' Net has no obligation to give you credit for the activities of your referrals. Earning in the Rovin' Net referral program are first-generation only. 

Members may not use Spam to Obtain Referrals:

You may not use unsolicited email, Usenet, message board postings, or similar methods of mass messaging (spam) to gather referrals. (Usenet and message board spam are messages sent or posted which are unrelated to the topic of discussion of the particular news group or message board.) The use of spam to promote the Rovin' Net referral program has strict negative consequences. Not only may Rovin' Net terminate the membership of anyone who in our reasonable opinion has used unsolicited email to gain referrals; Rovin' Net will also sever the branch of the "referral tree" made up of direct referrals obtained by the Spammer. The branch accounts (those under the Spammer) will not be terminated, but no one above the Spammer on the referral tree will benefit from the spamming activity. In addition, you may be subject to state and federal penalties and other legal consequences under applicable law if you send unsolicited email. Our Anti-Spam Policy (http://rovin.net/legal/anti_spam.htm) provides more details and is incorporated into this Agreement. 

Marketing Claims:

You agree not to make any misrepresentations to any potential referrals with respect to compensation typically received by Rovin' Net referral program members or with respect to compensation that potential members are likely to receive, and to fully comply with all applicable laws related to multi-level marketing programs. 

Web Master Program:

If you place a link to the Rovin' Net web site, Rovin' Net grants you a limited license to use the Rovin' Net trademarks and tradename as described on our Webmaster Program page solely for the purpose of seeking legitimate referrals to the Rovin' Net Service. This license is subject to the terms and conditions of our Trademark Usage Policy and License, set out on the Webmaster Program page, which may be varied by Rovin' Net from time to time. All use of Rovin' Net artwork shall be for the sole benefit of Rovin' Net and you hereby agree to assign and do all things necessary to: (a) ensure that Rovin' Net receives the benefit of such us, or (b) required by Rovin' Net to protect its image. Rovin' Net also reserves the right to revoke this license on a selective basis. Improper use of the Rovin' Net brand is strictly prohibited and Rovin' Net may terminate the account or cancel the membership of anyone who violates this policy. 


Disclaimer of Warranties. YOU EXPRESSLY AGREE THAT USE OF THE ROVIN' NET WEBSITE AND REFERRAL PROGRAM IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, ROVIN' NET EXPRESSLY DISCLAIMS ALL CONDITIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. ROVIN' NET MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. 

Limitation of Liability. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER ROVIN' NET NOR ANY OF ITS PARENTS, MEMBERS, SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS MEMBERSHIP AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. If you are dissatisfied with the Rovin' Net Service or any promotional program available through the Service, your sole and exclusive remedy is to cancel your membership in Rovin' Net. 

Force Majeure. Rovin' Net will not be in default or otherwise liable for any delay or failure in its performance under this Agreement where such delay or failure arises by reason of an Act of God, or any government or governmental body, acts of war, the elements, strikes or labor disputes, power or system failures, failure of the Internet, computer hacking, or other causes beyond the control of Rovin' Net. 

Governing Law and Other Terms. Any action related to this Membership Agreement will be governed by the law of the state of Louisiana, U.S.A., excluding (1) principles of conflicts of laws, and (2) the United Nations Convention on Contracts for the International Sale of Goods, if applicable. Any action relating to this Membership Agreement shall be brought in the state or federal courts located in the Southwestern District of Louisiana, and You hereby submit to the exclusive jurisdiction and venue thereof. You agree to comply with the laws of Louisiana and the United States that apply to the use of this Service. If the law of your country, state, or province of residence prohibits or limits your participation in this Service, then you are responsible for complying with such laws and you agree to indemnify Rovin' Net against any breach by You. 

If any part of this Membership Agreement is held to be unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remainder will remain in full force and effect. This Membership Agreement is personal to you and you may not transfer, delegate, or assign this Referral Program Agreement, your referral network, your Rovin' Net account or other benefits you receive as an Rovin' Net Member to anyone. Any attempt by you to assign or delegate this Membership Agreement shall be null and void. Rovin' Net may assign this Agreement at its sole discretion. 

This Membership Agreement constitutes the entire agreement between You and Rovin' Net in connection with general membership in Rovin' Net and supersedes all prior agreements between the parties regarding the subject matter contained herein. If You are eligible for and choose to participate in the Rovin' Net promotional referral program, your participation in that service shall be governed by this agreement.
